Truck Driver Stops to Aid Motorist After Accident and Is Killed By Passing Semi-Truck

In a tragic truck accident that occurred near the Indianapolis International Airport, a truck driver was killed when he was acting as a good Samaritan trying to help other motorists in trouble. According to a report by IndyStar, the accident occurred on I-70 westbound just before four in the morning.Evidently, two cars had collided on the freeway and a passing truck driver stopped to render his assistance and do what he could to direct traffic away from the cars that were stopped in the center of the highway. However, as he was helping, another passing semi-truck struck the man, killing him instantly.

The driver of the semi-truck who hit the man was taken in by police for drug and alcohol testing. At the moment, police do not suspect that drugs or alcohol were involved in the fatal accident. However, the original accident for which the victim had stopped was caused by a drunk driver. Apparently, one of the two drivers involved in the initial accident was arrested for driving under the influence after she was found to have had a blood alcohol content of .11.

Determining Fault in Indiana Truck Accidents

The accident described above was certainly tragic. A man who was acting out of good will was punished for putting himself before others. In these types of accidents, it is only natural to think, “whose fault is this?”

In many Indiana fatal truck accidents, multiple parties are at fault. Here, one might think that the drunk driver who was involved in the original accident was at fault for the man’s death because, but for her drunk driving, he would never have been in the position to have been hit by the passing semi-truck.

However, because the man had no duty to stop and render aid, and it was a choice he made on his own, it is doubtful that a court of law would hold the drunk driver liable for the victim’s injuries. That does not mean that the family of the man is without a means of recovery, however. It is possible that the passing semi-truck driver was negligent in hitting the accident victim.

In these tough cases, it is usually up to a jury to decide who is able to recover, and for what amount.
