The rights and duties of bicycle drivers in Indiana

On Behalf of Parr Richey Frandsen Patterson Kruse LLP | May 15, 2025 | Bicycle Accidents |

Bicycling is a beloved activity for many in Indiana, offering a means of transportation and a way to enjoy the outdoors. Still, sharing the road with motor vehicles can present significant risks. To safeguard cyclists, Indiana has various laws that address bicycle safety and accident liability.

Bicycle safety laws in Indiana

Indiana has established specific laws to ensure the safety of bicyclists. For example, Indiana Code 9-21-11-2 grants cyclists the same rights and duties as motor vehicle drivers. This means that they must adhere to traffic rules. Cyclists must stop at red lights and stop signs like drivers and use hand signals to indicate turns.

Furthermore, cyclists must equip their bicycles with a front white light and a rear red light when riding at night, ensuring visibility to other road users. Although not mandatory, using a bike bell is advisable to alert pedestrians and other cyclists when needed.

Despite these safety measures, bicycle accidents remain a concern. They are often caused by inattentive drivers who fail to adhere to traffic laws. Unfortunately, cyclists can face severe injuries in collisions. To reduce damage, drivers must exercise caution and maintain a safe distance when cyclists are passing, as mandated by Indiana’s safe passing law.

What can you do if you are involved in an accident?

In the aftermath of a bicycle accident, taking timely action is vital. Document the accident scene, gather contact information from witnesses, and seek medical attention for any injuries. You can also contact the authorities to inform them about the accident.

If you or a loved one has been involved in an accident, you should also seek legal assistance promptly. An experienced personal injury lawyer can help establish liability and ensure you receive fair compensation for your injuries. This may include coverage for medical expenses, property damage, pain and suffering, and lost wages.

Bicycling in Indiana can be enjoyable and safe when cyclists and drivers adhere to the laws. Understanding these rules and knowing your rights can make a difference. In the unfortunate event of an accident, knowing the legal procedures can help you address the situation effectively.
